All
those who believe that professional and academic communities, as well as public
officials, are freer in their speech and should be more tolerant, including in
cases involving prohibited types of speech, have a mistaken understanding of
the system of rules regarding integrity, ethics, and conduct. These rules
require much greater vigilance regarding speech, and failure to comply can
result in disciplinary liability.
At
the same time, it is unacceptable to assume that any type of speech violating
these rules should automatically lead to criminal liability. Extreme caution is
required when applying criminal sanctions for speech, especially when it
involves depriving individuals of their liberty.
