The
Human Rights Defender of the Republic of Armenia, Ms. Anahit Manasyan,
considers the draft law amending the RA Law on "Military Service and the
Status of Military Personnel" to be problematic. This refers to the
amendments to Part 1 of Article 65 of the aforementioned law, entitled “Housing
Security for Servicemen,” according to which:
Instead
of the current 30 kilometers, the lack of a residential property with ownership
rights at a distance of at least 60 kilometers from the administrative territory
of the place of service or a permanent (de facto) residence at the same
distance will be considered a housing improvement need at the place of service,
The
draft proposes an amendment to stipulate that the costs of registering a lease
agreement with the state will be covered by the state budget once per fiscal
year,
The
draft law is also problematic as it applies retroactively and contains
provisions that worsen the legal situation of military personnel.
It
should be noted that even before the circulation of this draft law, the Human
Rights Defender’s Office had been receiving complaints from military personnel
and their family members regarding housing issues. These concerns have been
thoroughly addressed in the Defender’s annual reports.
The Human
Rights Defender notes that the circulating draft has further deepened existing
concerns.
