In
the process of assessing the functionality of persons held in a penitentiary
institution in order to discuss the issues reported by the Human Rights
Defender at the initiative of the Defender, a meeting was organized with
representatives of the competent authorities on July 9, 2024.
Representatives
of the Ministry of Labor and Social Affairs of the Republic of Armenia, the
Unified Social Service, and the Penitentiary Service of the Ministry of Justice
of the Republic of Armenia participated in the discussion.
The
purpose of the meeting was to jointly discuss with all competent authorities
the reasons for the delay in the process of assessing the functionality of
persons kept in penitentiary institutions, identify existing problems and
outline ways to solve them.
During
the meeting, among other things, problems related to the compatibility of the
"ARMED" e-health system and the "e-disability" electronic
systems, technical cooperation, interdepartmental cooperation of competent
authorities in the "e-disability" electronic system, proper
administration, lack of specialists, incomplete legislative regulation were
presented.
The
participants of a meeting, as a reason for the improper organization of the
process of assessing the functionality of persons held in the penitentiary
institution, also noted unnecessary delays in the organization of necessary
medical examinations, preparation of packages of medical documents and referral
by the "Penitentiary Medical Centre" SNPO.
It
was emphasized that some of the issues raised as a result of the discussion
relate not only to persons held in penitentiary institutions, but also to the
functional assessment process of each person applying for a functional
assessment.
As a
result of the discussion, directions for solving problems arising in the
process of evaluating human functionality were outlined, an agreement has been
reached on further cooperation in relation to the protection of the rights of
persons in the functional assessment.
In
connection with the issues discussed as a result of the meeting, the Ombudsman
will send letters to the relevant competent authorities.
