Analysis in relation to the explosion of the "Surmalu" shopping center on August 14 and the collapse on September 21, was conducted by the assignment of the Human Rights Defender.
The analysis carried out on the explosion that killed sixteen people (one person is considered missing) was summarized in the ad hoc report, within the framework of which, in particular, received information on the explosion of "Surmalu" shopping center in Yerevan on August 14, 2022, were collected, analyzed and summarized, as well as the Defender pointed out the actions to be carried out by competent state bodies. At the same time, the collapse of September 21 following the explosion of August 14 and the possibilities of implementing legal mechanisms in this regard were discussed in the Report.
As a result of inquiries and studies carried out during the preparation of the report, it was recorded that before the explosion took place on August 14, RA Urban Development, Technical Standards, and Fire Safety Inspection Body carried out inspection operations and recorded a series of violations, while no measures were taken until the explosion to verify the fulfillment of the requirements of the decree issued on the elimination of violations.
At the same time, concerning the collapse following the explosion, the lack of enough legal structures in the RA legal system for taking operative and effective measures towards dismantling the property threatening the public was recorded.
The Defender presented substantive recommendations regarding the recorded issues to cover the gaps, as well as to develop effective legislative mechanisms for addressing similar situations.
