During
the first 9 months of 2021, the Office of the Human Rights Defender received
485 written and oral complaints on issues related to children’s right from 753
persons.
The
applications-complaints addressed to the Defender mainly raised issues related to
the trusteeship and custodianship commission, the exercising of the right of
the child to communicate with the parent, and the ensuring of the realization
of their right to education, etc.
The applications-complaints
addressed to the Defender were related to the failure to be guided by the best
interest of the child that during the enforcement proceedings initiated in the
Compulsory Enforcement Service of the Ministry of Justice, and the failure of
the proper application of the requirements of the performance sheet.
The
issues related to the activities of the trusteeship and custodianship bodies
are systemic in nature, and have not been solved over the years. The issues are
related to the inactivity of the trusteeship and custodianship, the improper
exercise of their mandate, the legality of its conclusions and decisions, and
the failure or the improper guaranteeing of the rights of the child to contact
with their parents, grandparents and other relatives, and the right to receive
parental upbringing.
The Office
of the Human Rights Defender, as provided by law, has responded to the
applications-complaints to provide solutions to the systemic and individual
issues raised by them, and to ensure the exclusion of such issues in the
future.
During
the studies of the application-complaints and the discussions, the Office of
the Defender has collaborated with the competent state and local self-governing
bodies. Moreover, when necessary, the Defender requested explanations on the
raised issues from the above-mentioned bodies, as well as concrete measures a s
prescribed by law.
During
its activities, the Office of the Human Rights Defender underlined the
importance of the need to be guided by the best interests of the child in any
situation, and to demonstrated an individual approach during the steps taken to
protect the rights and interest of each child.
