On
September 27, the Human Rights Defender Mr. Arman Tatoyan received the
delegation of Swedish National Courts Administration (SNCA).
During
the meeting, the details of the programs aimed at increasing the capacities of
the courts in Armenia were discussed; the program will be implemented with
judicial system of Sweden.
Mr.
Arman Tatoyan focused on the current issues of the judicial system, and
stressed that there are individual judges who are damaging the reputation of
the courts through their behavior. However, solutions should be reached through
legal means, encouraging independent and impartial judges.
The
Defender referenced the inadmissible practice of delays in court proceedings.
He noted that the studies of the received complaints demonstrate the fact that
judicial proceedings in courts take years, violating the constitutional right
to judicial hearing within reasonable time and in such cases there are no
effective mechanisms to restore violated rights of people.
The
issue was not resolved even after the publication of the ad hoc report of the
Human Rights Defender, and his application to the Constitutional Court.
The
Defender informed that during the examination or discussion of the complaint,
he is authorized within his competence, to apply to the judicial authorities,
to the bodies responsible for summarizing the judicial practice, to receive
advisory clarifications on legal issues, as well as to submit suggestions on
the improvement of judicial practice.
The Defender
emphasized the role of the Supreme Judicial Council, in particular in the issue
of increasing the institutional trust in the courts. The defender underlined
the effective cooperation with the Council.
During
the meeting, the parties expressed their readiness to improve the cooperation
within the framework of the program to improve the judicial system.
