The
Human Rights Defender's Institution was involved in the public procurement
complaint hearing.
The
discussed issue during the session was that the Ministry of Finance initiated a
procedure to include the entrepreneur in the list of participants not entitled
to participate in the procurement process based on the letter of the ordering
organization. According to the customer, the participant submitted to the
tender a product with specifications that did not correspond to the technical
specifications provided by the invitation. The evaluation committee demanded
from the participant to correct the inconsistency, which was not implemented.
According
to the entrepreneur, the company has participated in the procurement process
with an equivalent product, therefore incomplete matching of standards was
possible.
During
the session, the representative of the Human Rights Defender presented the
position in favor of the business entity regarding the lack of grounds to
include the participant in the list of participants who are not eligible to
participate in the procurement process. As a result, the business entity was
not included in the list of not eligible participants of the procurement
process.
