The
father of a conscript studying abroad requested the Human Rights Defender’s
assistance in registering his son in the Armenian Armed Forces reserve and in
providing him with an Armenian citizen's passport.
The
applicant informed that his son was admitted to a foreign university and
received a deferment.
According
to the citizen, although his son’s military deferment had not been finished and
he had not received a notification to appear in military commission, a criminal
proceeding was initiated for evasion from conscription. According to the
citizen, his son had returned to Armenia to get a new passport, but due to the
initiated criminal case, the passport was not provided and now he cannot return
abroad to continue his studies.
A
discussion procedure has been initiated at the Office of the Human Rights
Defender, an official letter has been addressed to the RA Prosecutor General's
Office with regard to the raised issue. In the clarification, the Prosecutor's
Office informed that the criminal prosecution against the conscript was
terminated and the criminal case was suspended due to the lack of corpus
delicti in the act.
The conscript's father further informed that his son was registered in
the Armed Forces reserve, received a military service book and a passport.
