In a state of emergency, the Human
Rights Defender works in an emergency regime.
Monitoring and examination of
complaints indicate about the necessity to inform the public that the
Constitution of the Republic of Armenia prescribes rights that are of an
absolute nature and cannot be restricted during a state of emergency.
These include the following main
rights:
• right
to apply to the human rights defender,
• right
to judicial protection and the right to apply to international bodies for the
protection of human rights,
• right
to fair trial, right to receive legal aid, presumption of innocence,
• right
of a sentenced person to appeal, right to seek pardon,
• human
dignity and right to life,
• right
to physical and mental integrity, prohibition of torture,
• general
equality before the law,
• freedom
to marry,
• rights
of the child,
• rights
to education (except the right to education on a competitive basis),
• freedom
of thought and religion.
