The Human
Rights Defender published an ad hoc report on guaranteeing the rights of police
officers during criminal persecution.
In particular,
the discussions of individual complaints addressed to the Defender revealed
that there is a legislative issue on guaranteeing the rights of police officers
during criminal prosecution against them.
The current
legislation provides that once there is a criminal proceeding against a police
officer, the latter does not have the opportunity to receive a salary, resign
from service at his own initiative and be appointed to another position, except
for scientific, pedagogical and creative work.
As a
result, in case of an absence of a final judicial act proving the police
officer’s guilt, the police officer and their family members may face the issue
of addressing their priority needs.
The Human
Rights Defender has also applied to the Constitutional Court with regard to
this issue.
