The
Human Rights Defender examined the civil activities conducted in the vicinity
of the Open Society Foundations-Armenia office, as well as the statements of
the Office and a number of other civil organizations thereof. Public reactions to these actions have also
been examined.
Considering
its mandate, entrusted by the law, the Defender records,
1) Every
process taking place in the country should unconditionally be based on the rule
of law. Any initiative should be based on human rights and respect thereof.
2) Freedom of speech is one of the key indicators of democratic
development of the country: there is no alternative to guaranteeing this value.
This is directly linked to the promotion of dissent. It is through freedom of
speech that a person shapes his or her attitude towards the processes taking
place in society and expresses it publicly.
3)The
rights and freedoms of all must be respected, and any act of unlawful
interference must be prohibited. This is the guarantee of solidarity in the
society and an atmosphere of mutual respect.
4) It
has been a long time that Intolerance and speech insulting dignity has reached an
acceptable level.
This
phenomenon is unacceptable in terms of solidarity and human rights system in
the society. It is concerning that the private life is being targeted, and
illegal interference with private and family life takes place. It happens both on and off social networks.
Moreover, comments and posts on social networks are more aggressive.
5) This
situation is impressible. The Human Rights Defender has always made statements
about its danger.
No right
or liberty should be opposed to the realization of guaranteed rights or
freedoms of others. In this regard, it is not acceptable to make statements
humiliating one's private and family life, insulting dignity. This is
especially dangerous as it negatively impacts on the atmosphere of solidarity
in society and can lead to violence.
The
Human Rights Defender has always urged to exclude such any situation. It may
not be permissible in any circumstances: it is unacceptable in any case.
6) Human rights and the protection of dignity do
not tolerate differentiated approaches. Double standards or such perception
should be excluded.
7) In this respect, any speech insulting dignity
or hate speech or any act with such intention during civil activities is
impermissible, regardless of who is doing that or who is targeted.
8) The
Human Rights Defender addressed an official letter to the acting Chief of the Police
with regard to particular questions.
