The Constitutional Court accepted the
application of the Human Rights Defender on guaranteeing the rights of police
officers.
The issue
is that according to the current legislation, once there is a criminal
proceeding against a police officer, the latter does not have the opportunity of
receiving salary, resigning from service at his own initiative and being appointed to another position,
except for scientific, pedagogical and creative work.
As a
result, a number of their rights are violated, specifically, the freedom to
choose a job, the right to respect for one's private and family life, as well
as constitutional principles of prohibition of discrimination, presumption of
innocence and proportionality. The examination of challenging provisions of RA
laws “On Police Service” and “On Approval of Police Disciplinary Code” will
take place on December 2019.
