On July 11, 2025, as a result of monitoring of the mass
media and social media networks by the Human Rights Defender's Office, as well
as an alert made by a lawyer to the Defender’s hotline, information was
received that a mother of young children had been detained by a court decision.
It is important to emphasize that, according to the
Constitutional Law of the Republic of Armenia “On the Human Rights Defender”,
the Defender is not authorized to interfere in court proceedings or in the
exercise of the powers of judges in a specific case. under the direct attention
of the Defender, and appropriate steps have already been taken and are being
taken on the Defender’s instructions to guarantee the rights of individuals,
including the issue of providing child care.
On July 12, the Human Rights Defender’s hotline received
another alert from a lawyer regarding several issues related to the guarantee
of rights, which were resolved with the intervention of the Human Rights
Defender.
Additionally, as a result of the monitoring, it was
recorded that a video with the participation of a child was distributed on the
Internet by a lawyer. It should be noted that in such sensitive situations,
children are often targeted and become more vulnerable as a result of such actions.
Monitoring conducted by the Human Rights Defender, as the
body responsible for monitoring the implementation of the provisions of the UN
Convention on the Rights of the Child, indicates that such cases and
insensitive approaches towards children are generally ongoing.
The Defender strongly emphasizes the need to exclude any
violations of children’s rights, including the right to the protection of their
personal data, and any behavior that targets children. Any process involving
children must be carried out in accordance with the principle of the best
interests of the child and the do no harm principle.
When publishing or otherwise making children's personal
data accessible to another person, the requirements established by both
international and national legislation on the protection of personal data must
be strictly observed.
