The Human Rights Defender Ms. Anahit Manasyan continues
to receive numerous complaints regarding the loud music and noise coming from
public food courts, entertainment venues located in various localities of
Armenia, especially in the capital, as well as construction work.
The Defender emphasizes that it is extremely important to
observe the rules of coexistence, and the state is responsible for ensuring the
basic rights of people in this area, including recreation, health protection
and other rights.
Noise, which is constant or periodic in conditions that
do not meet international standards, negatively affects people's health,
violates the conditions necessary for their rest.
It should be borne in mind that around us there are
people with health problems and disabilities, the older persons, children, as
well as medical institutions, for the normal functioning of which, especially
late in the evening and at night, maintaining silence is vital.
The Defender draws the attention of the competent state
bodies to the above-mentioned issue and calls for the development of mechanisms
based on the successful experience of other States that will provide the
necessary conditions for the recreation of the population and other basic
rights. These mechanisms may also relate to the implementation of necessary
legislative and other changes.
Taking into consideration the fact that issues related to
exceeding the permissible noise level mainly relate to the private sector, and
the Defender is not authorized to consider complaints against private
organizations, written complaints received by the Defender's Office are
considered and, with the written consent of the persons who filed the
complaint, are transferred to the Health and Labor Inspection body of the
Republic of Armenia. Further consistent work is underway on their progress.
Given the large number of complaints, the Defender will
be attentive in developing systemic solutions to the problem.
In the case of oral complaints, legal advice is provided
to individuals regarding their rights and freedoms, as well as the possibilities
of their effective protection.
As a result of the consideration of applications and
complaints within the scope of the Defender's competence, consideration
procedures are initiated, and clarifications are required from the competent
state and local government bodies.
