In Armenia’s complaint v.
Azerbaijan in the UN International Court of Justice (ICJ), the ad hoc reports and
other evidence gathered during fact-finding activities of the Human Rights
Defender Mr. Arman Tatoyan are used.
The complaint also
contains quote from the closed reports of the Human Rights Defender; these
reports are accessible to the Court through the annex attached to the
application.
The complaint contains
separate parts, which refers to the inhuman and cruel treatment of Armenian
captives and civilians. There are also references to the latest report
published by the Human Rights Defender (https://bit.ly/3ER4Nwd),
where the responsibility of Azerbaijan in the inhuman treatment and torture of
the Armenian captives is demonstrated through concrete evidence.
In the section on the
rights of the Armenian captives and civilians, there is another reference to
the ad hoc report of the Human Rights Defender, where the fact that the results
of the interrogations of the Armenian captives cannot be used as a basis for
criminal prosecution is presented in detail, and cannot be used as evidence in

Armenophobia is written
in detail in the Armenian complaint which is based on the International
Convention on the Elimination of All Forms of Racial Discrimination; as
evidence, the joint ad hoc report of the Human Rights defender of Armenia
published with the Human Rights Ombudsman of Artsakh is presented (https://bit.ly/2W9RpBU).
The report substantiates the facts of the Azerbaijani policy of ethnic
cleansing and genocide through terrorist methods. The report evidence that the
Azerbaijani atrocities, tortures and inhuman treatments during the
September-November 2020 war are the result of years of systemic propaganda of
enmity and a policy of Armenophobia.
The Report also evidences
that Armenophobia in Azerbaijan is in a closed cycle; it is generated by the
Azerbaijani authorities, including the highest ones, and afterwards it is
widely used almost identically and encouraged by cultural, sports and public
figures, and receive public praise, frequently targeting children.
The ad hoc closed reports
of the Human Rights Defender of Armenia and the Huma Rights Ombudsman of
Artsakh, which are concerned with the atrocities committed by the Azerbaijan
armed forces against Armenian captives and dead bodies, are used in the
complaint.
The ad hoc report on the
fact-finding activities on the shelling of villages in the vicinity of Vartenis
of Gegharkunik province by Azerbaijani UAVs during the September-November 2020

A separate section in the
complaint is dedicated to the destruction of Armenian cultural heritage by
Azerbaijani servicemen during the war. In this section a reference is also made
to video documented by the Human Rights Defender (https://bit.ly/3o1P9s6),
which refers to the vandalism of the Armenian Saint Yeghishe Church of
Mataghis. According to the Human Rights Defender of Armenia, this is an act
committed based on ethnic and religious hatred. Moreover, this is not an
seperate incident, but is the result of years of systematic policy of hatred
and enmity in Azerbaijan, which continues today.
