Late last night, the Human Rights
Defender completed the next stage of the examination of the evidence, and the
legal analyzes concerning the Azerbaijani atrocities during the war
against our captives, both military servicemen and civilians.
The cases of torture and cruelty of
the Azerbaijani Armed forces, and that of inhumane treatment are many, and
there exists clear elements of war crimes, motivated by ethnic
hatred.
Grave war crimes have been committed
and it is very urgent to register the evidences, and strengthen the grounds for
criminal prosecution of the Azerbaijani authorities.
It is important to show, for
example, the number of cases where Azerbaijani soldiers have been identified
(specially many of them are in the photos and videos with their faces
uncovered), or to show what has been done to identify them, against how
many Azerbaijani serviceman arrest warrants are issued, what crimes are
committed by which Azerbaijani authorities, and what steps are taken to
prosecute them.
The Armenian Government should
convey this important messages to our society, to which these issues are of an
important priority, as well as to the international community and the
Azerbaijani authorities.
The Azerbaijani authorities must
understand they will not remain unpunished for the gross violations of
human rights, the war crimes, the organized propaganda of Arachnophobia, and
their genocidal policy. It is important to show that all effort is made in
our country for this purpose.
Impunity will lead to new
atrocities and new cases of torture.
We must not allow that to occur.
Every day and every hour is precious.
The executive branch of Armenia,
with its bodies, have a principled role in the mentioned issues.
Organized and targeted work is
needed to protect the rights of our compatriots in captivity.
These issues should be among our
main priorities, the professional input of every person should primarily serve
these targets.
Instead, a discussion took
place in the Armenian Government on November 30, which was dedicated
to the criminal proceedings concerning other topics and criminal prosecution of
specific persons, issues related to their detention or release.
We consider it inadmissible the
participation of a number of judges and some members of the Supreme
Judicial Council in that discussion. Such discussions endanger the independence
and reputation of the judicial authority.
The courts are required to ensure a
person's right to personal liberty, the right of fair trial and the protection
of other rights. They can effectively solve this problem only if the
guarantees of the external and internal independence of the judiciary are fully
operational and the appearance of that independence is fully ensured.
P.S. During these days we have been working closely with human rights
defenders Ms. Siranush Sahakyan and Mr. Artak Zeynalyan, with the
Ombudsman of Artsakh Mr. Artak Beglaryan, as well as the Representative of
Armenia to the ECHR Mr. Yeghishe Kirakosyan to register the atrocities of the
Azerbaijani armed forces, and concerning the issues with regard to protection
of rights of our captives. We also cooperate with the Armenian Investigative Committee,
the National Security Service, and the Prosecutor’s Office in this regard.
