The examination of complaints addressed
to the Human Rights Defender on labor rights revealed the following main issues:
1) Employers do not make final payments
to employees;
2) Employees are unjustified dismissed
from their positions;
3) Employers do not comply with procedure
on disciplinary action against employees;
4) Employers make ungrounded deductions
from employees' salaries;
5) Before terminating the employment
contract, the employers do not notify the employees about it within the terms
defined by law;
6) Without the consent of the
employees, the employers transfer them to another job, etc.
The 2019 annual report of the Defender,
for example, shows that citizens who have applied to the Human Rights Defender
have also raised other cases of violations of their labor rights.
The common and systemic issues are the
following:

Failure to sign employment contracts
with employees when hired to work;

Forcing employees to file a resignation
letter;
·
Failure to pay employees for overtime
work, etc.
Examination shows that one of the main
reasons for such issues is the lack of awareness on their rights.
The 2019 annual report of the Human
Rights Defender contains a detailed analysis of each issue with relevant recommendations.
The 2019 annual report also raised an issue of not having an extrajudicial body
for the protection of labor rights in our country and that the only way to
restore the violated rights is to go to court. People also avoid applying to
court, because they find themselves in a long court dispute and have no
confidence in whether they will achieve a positive result.
