Any act of
violence is absolutely unacceptable: The Human Rights Defender examined
publications on the death of a 43-year-old woman as a result of beating and
violence against her child in detail.
According
to the public information available at the moment, the violence in this
specific situation led to a tragic death of a woman
It is
particularly concerning that according to the public sources, the child was
also subjected to violence. Violence in general and such violence in
particular, can cause irreversible harm to woman’s and child’s physical and
mental health and to the child’s further development. This type of violence
directly undermines family values and contradicts the essence of the child's
right to live in the family and child’s best interest․
Unfortunately,
stereotypes about women have not yet been overcome in the society. This is an important factor that has a negative
impact on the whole prevention process.
From a
systemic point of view, starting from the initial stages of the investigation
till the delivery of the final judicial act, there is no effective mechanism to
examine these cases.
The
legislation is incomplete, which fails to enable effective protection for
persons subjected to violence, full disclosure and prevention of possible
future cases. Besides, the practice is also problematic. It is important to improve
the initial stages of investigation, the rapid response of law enforcement bodies
and to ensure the relevant specialization.
It
should not be limited to case-by-case investigation, but the reasons and contributing
factors should be analyzed in detail, establishing a practice based on the
results.
Within
the Human Rights Defender’s mandate, this case will be in the center of the
Defender’s attention.
